General Terms and Conditions (GTC) for Taxi Companies Oudi Al Kafrey
1. scope of application
These General Terms and Conditions (hereinafter referred to as “GTC”) govern the contractual relationship between the cab company Oudi Al Kafrey (hereinafter referred to as “we”, “us” or “the company”) and our passengers (hereinafter referred to as “you” or “the customer”). The GTC apply to all cab and transfer services provided by the cab company Oudi Al Kafrey. Deviating terms and conditions shall not apply unless they are expressly accepted by us in writing. A contract is only concluded if it is confirmed by us in writing.
2. scope of services
Our offers are subject to change and are based on our written order confirmation. Verbal or telephone ancillary agreements shall only apply if expressly confirmed by us in writing. Transportation is provided in accordance with Austrian road traffic regulations and the Passenger Transportation Act. Passengers are obliged to follow our instructions or those of the driver. We reserve the right to refuse transportation in the event of misconduct on the part of passengers or if road safety is endangered due to impairment of the chauffeur. In this case, the full fare, including fixed price or kilometer price and all additional and special services, will be charged.
3. pick-up at the airport (airport transfer)
Changes to the agreed pick-up time must be communicated to the cab company Oudi Al Kafrey immediately in order to avoid possible damages. Our chauffeur will be ready at the agreed pick-up time at the airport meeting point or at a meeting point agreed in advance in writing, with a name sign or company logo. The waiting time is up to 15 minutes without extra charge. After the 15-minute waiting period has elapsed without contact with the passenger or customer, the order is considered fulfilled and the full fare is due. Additional waiting times will be charged according to our valid price list.
4. prices
Our prices include VAT at the statutory rate. The prices apply in accordance with our price list valid on the day of booking confirmation. Flat rates not listed can only be agreed in writing and are only valid for the agreed date of travel and the agreed rental period. Times and distances exceeding the agreed rental period and distances will be charged according to our valid price list. Additional costs due to delays that are not attributable to the fault of the cab company Oudi Al Kafrey or the chauffeur shall be borne by the customer. The fare includes the transportation of passengers with normal luggage; the transportation of bulky goods requires a separate agreement.
5. terms of payment
Payments can be made either in cash or credit in euros to the chauffeur after the transfer or before the start of the journey by online transfer. Final payments are due at the chauffeur at the latest. The timeliness of the payment depends on the successful transaction of the credit card debit of the cab company Oudi Al Kafrey. Payments are used to settle the oldest receivables. In the event of late payment, the cab company Oudi Al Kafrey shall charge interest at a rate of 4 percentage points above the prime rate, subject to further default charges. A reminder fee of € 10 will be charged for the second and each subsequent reminder.
In the event of non-fulfillment of payment obligations, we reserve the right to initiate civil law measures.
6 Cancellations and withdrawal
Cancellations must be made in writing (by e-mail). The timeliness of written cancelations depends on their receipt by Travel-Tirol. Cancellations up to and including 24 hours before the contractually agreed start of the journey are free of charge. In the case of cancelations, Travel-Tirol charges a proportion of the basic fare as a cancellation fee according to the following scale:
- 50 % in the event of cancellation up to 12 hours before the agreed start of performance.
- 75 % in the event of cancellation up to 3 hours before the agreed start of performance.
- 100 % in the event of later cancelations and no-shows.
Expenses that have already been incurred will be charged irrespective of the timeliness of the cancellation. The customer is expressly permitted to prove that Travel-Tirol has incurred no or less damage. Travel-Tirol reserves the right to withdraw from the contract in whole or in part if the customer stops making payments, becomes insolvent, misuses the services or if other serious reasons make it unreasonable for Travel-Tirol to perform the contract. In such cases, any payment already made will be refunded on a pro rata basis according to the status of the services rendered, unless a loss already incurred exceeds the payment made.
In the event of a proper cancellation, the customer will be refunded the full amount to the original means of payment used.
In the event of a no-show, all subsequent transfers will be canceled without further notice.
7. liability
The company is liable within the scope of the statutory provisions for the due care of a prudent businessman. Liability for damage that has not occurred to the object of transportation itself is limited to intent and gross negligence. The cab company is not responsible for delays caused by force majeure, traffic obstructions, unforeseeable road closures, extreme weather conditions and other circumstances beyond our control.
We are only liable for loss of or damage to baggage up to a maximum amount of EUR 500, unless the damage was caused intentionally or through gross negligence. The customer is obliged to inform the company immediately of any damage and to complain about it when the luggage is handed over.
8. data protection
The customer’s personal data is processed exclusively in accordance with the statutory provisions of the Data Protection Act. Data will only be passed on to third parties if this is necessary to process the contract or if there is a legal obligation to do so.
9. final provisions
Amendments or additions to these GTC must be made in writing. This also applies to the waiver of this written form requirement. Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic intent of the invalid or unenforceable provision.

The place of payment is the registered office of Travel-Tirol. - The law shall apply to contracts concluded within the scope of these GTC
of the Republic of Austria. - For all disputes arising from or in connection with the
Innsbruck is agreed as the place of jurisdiction for all disputes arising from this contract.
Travel-Tirol shall also be entitled to make the client liable for its general
place of jurisdiction.
